Terms and Conditions - Nice Parapente

1. Booking

1.1 Booking conditions

To take part in a first paragliding flight with Nice Parapente, you need to book in advance, subject to availability.

1.2 Booking confirmation

The day before your flight to 8pm sharpyou will receive an SMS containing :

  • The exact GPS location of the meeting
  • Your precise time slot
  • Terms of payment
  • Dress for the conditions

You must be available all day because nature decides on the best flight slots.

1.3 Acceptance of the GTCS

By booking a paragliding experience, you accept these General Terms and Conditions of Sale, the Legal Notice and the Nice Parapente Quality Charter. If you are booking a group, it is your responsibility to inform all participants of these conditions.

2. Prices and payment

2.1 Prices

Our prices are quoted in Euros incl. VAT and include :

  • Supervision by a state-certified instructor
  • Loan of approved equipment (tandem glider, harness, helmet)
  • Insurance (professional liability and personal accident)

Our prices do not include :

  • Transport to the meeting point
  • Accommodation and catering
  • Personal equipment (clothing, sunglasses)
  • Video option (additional €30 except for Prestige flights)

2.2 Formulas on offer

  • Child flight 90 (10-15 min, under 25 kg)
  • Ascending flight 130 (20-30 min) + video option €30
  • Prestige flight 250 (45 min-1h, including video)

2.3 Payment methods

Payment must be made by :

  • Species
  • Cheque
  • Credit card
  • Bank transfer

Payment is due on the day of the activity, unless otherwise agreed in advance for groups.

2.4 Gift vouchers

Gift vouchers are valid 1 year from the date of purchase and are subject to the same conditions as standard bookings.

3. Participation conditions

3.1 Compulsory physical conditions

To take part in a paragliding experience, you must :

  • Be able to run 5 to 10 metres on take-off and landing
  • No major joint problems (hips, knees, ankles)
  • Respect weight limits :
    • Child flight: minimum weight 15 kg, maximum 25 kg
    • Adult flights: minimum weight 35 kg, maximum 90-100 kg depending on body shape
  • Not be overweight (assessment by the instructor)

3.2 Contraindications

Paragliding is contraindicated in the following cases:

  • Pregnancy
  • Recent operation or non-healed injury
  • Serious heart problems
  • Uncontrolled epilepsy
  • Significant balance problems

3.3 Health requirements

It is imperative that each participant is :

  • In top physical condition on the day of the flight
  • In good general health
  • Not under the influence of drugs or alcohol

Any medical constraints must be notified to the instructor in advance (asthma, diabetes, medical treatment, medical history, etc.).

No medical certificate is requiredIf you are in any doubt about your state of health, please consult your doctor before booking.

3.4 Exclusion

The instructor reserves the right toexclude a participant without refund if :

  • Does not comply with safety instructions
  • Represents a danger to himself or others
  • Concealed a medical contraindication
  • Is not in a state to fly (alcohol, drugs, state of health)
  • Does not meet the physical requirements

4. Acceptance of Risks

The paragliding activities offered by Nice Parapente are carried out in a unsafe natural environment (mountains, variable weather conditions).

By booking a flight, you acknowledge that you are aware that paragliding involves inherent risks even when supervised by qualified professionals using approved equipment.

Nice Parapente does everything in its power to guarantee your safety (qualified instructors, inspected equipment, weather analysis, safety protocols), but cannot guarantee the total absence of risk.

5. Insurance

5.1 Nice Parapente insurance

All our instructors are state graduates (DEJEPS or BEES Parapente) and approved by Jeunesse et Sports. They have a professional indemnity insurance covering the supervision of first paragliding flights.

All supporting documents are available on request.

5.2 Passenger insurance

A personal accident insurance is included in the price of your flight and covers bodily injury arising from paragliding.

5.3 Recommended personal insurance

We strongly advise you to check your personal insurance for damage not directly related to paragliding (theft from a vehicle, accidents on the way to work, etc.).

6. Cancellation and postponement

6.1 Cancellation by the customer

In the event of cancellation by you (including gift vouchers) :

  • More than 15 days before full refund
  • Between 8 and 15 days before reimbursement to 50%
  • Less than 8 days before no refund

Cancellation must be notified in writing (email) to Nice Parapente.

Exception In the event of a duly justified case of force majeure (hospitalisation, death of a relative, etc.), a free postponement may be offered on presentation of proof.

6.2 Cancellation by Nice Parapente

Weather conditions

Nice Parapente, with your safety and enjoyment in mindreserves the right to cancel or postpone a flight if weather conditions are not favourable.

This decision is taken by the qualified instructor in charge:

  • Weather forecasts
  • Wind conditions
  • Visibility
  • On-site aerological conditions

In the event of weather cancellation :

  • No charge is applied
  • A free deferral is available to you
  • Validity of your reservation : 1 year

The decision to cancel may be taken :

  • The evening before (communication by SMS at 8pm)
  • The same morning in the event of unforeseen damage
  • On site if conditions deteriorate

Other reasons

Nice Parapente can also cancel a flight for :

  • Technical reasons (faulty equipment)
  • Unavailability of instructor (illness, accident)
  • Administrative closure of the flight site

In all these cases, a full refund or a free deferral will be offered.

7. Late arrivals and absences

7.1 Mandatory punctuality

A precise meeting place and time will be sent to you by SMS at 8pm the day before.

Out of respect for the instructor and the other participantsPunctuality is compulsory.

7.2 Customer delay

In case of delay :

  • Less than 15 minutes the flight may be maintained depending on conditions
  • More than 15 minutes the instructor can leave without you
  • No refunds or compensation will not be due in the event of absence or lateness

7.3 Notification in the event of impediment

If you are unable to keep your appointment, please notify us immediately by telephone. Depending on the circumstances, a postponement may be possible.

8. Image rights

8.1 Using images

Nice Parapente may take photos or videos during your flight for :

  • Promotional (website, social networks)
  • Advertising (brochures, posters)

These images can be used in a variety of media (print, video, internet).

8.2 Right to object

If you do not want your image to be used, you must :

  • Tell the instructor before the flight
  • Or send us your request by email after the flight

In accordance with the RGPD, you have the right to right of access, rectification and deletion images about you.

9. Video option

9.1 Optional service

The video option (€30 for children and ascending flights) allows you to receive a complete HD film of your first flight.

For the prestige flight (€250), the video is included in the price.

9.2 Submitting the video

You will receive the video immediately after the flight :

  • On SD card or USB key
  • By online digital transfer

9.3 Ownership

You become owner of the video and can use it freely for your own personal use.

10. Valuables

Customers are warned that they are strongly discouraged leaving valuables in a vehicle during the activity.

Nice Parapente cannot be held responsible for in case of :

  • Theft from vehicles
  • Loss of personal belongings
  • Damage to parked vehicles

We recommend that you do not take any valuables with you to the take-off site.

11. Liability

11.1 Responsibility of Nice Parapente

Nice Parapente makes every effort to guarantee your safety and the quality of your flight. However, Nice Parapente cannot be held responsible in the event of :

  • Accident resulting from the passenger's failure to comply with safety instructions
  • Concealment of a medical contraindication
  • Theft of or damage to personal property
  • Force majeure event

11.2 Participant liability

The participant undertakes to :

  • Follow the instructor's instructions
  • Report any medical contraindications
  • Be in good physical condition
  • Not be under the influence of alcohol or drugs

12. Claims and disputes

12.1 Complaints

We promise to respond within 48 hours and find an amicable solution.

12.2 Mediation

In accordance with Articles L.616-1 and R.616-1 of the French Consumer Code, in the event of a dispute that cannot be resolved amicably, you may have free recourse to a consumer mediator: [Name of mediator to be completed].

12.3 Applicable law

These General Terms and Conditions are subject to French law. In the event of dispute, jurisdiction is given to the courts of Nice, after an attempt at amicable resolution.

13. Modification of the GTCS

Nice Parapente reserves the right to modify these GCS at any time. The conditions applicable are those in force at the time of your booking.
